Dispute Resolution

Expert dispute resolution

At XL Insurance's Design Professional group, we're committed to helping you avoid disputes. Yet we realize that problems sometimes happen. When they do, we bring you the expertise and guidance of the industry's leading loss prevention specialists. Our experienced claims consultants operate out of several regional offices across North America, and they understand the unique regulations and laws in the areas they serve. They work closely with you to resolve disputes, protect your interests and reduce the cost of loss.

Here are some of the other resources we offer to help policyholders resolve disputes:
  • At the first sign of trouble: Early Warning System
The Early Warning System enables you to collaborate with an experienced claims consultant at the first sign of trouble – and mitigate the damage to your business. We'll work carefully to help you resolve the issue, using alternative dispute resolution (ADR) techniques to protect your interests and preserve valuable relationships. In many cases, an actual claim and its inherent costs can be avoided.

Unless the dispute escalates into a formal claim, the Early Warning System will not impact your deductible, liability limit or premium.

  • Reduce the cost of claims with mediation
Mediation brings opposed parties together and can often reduce the time and money it takes to resolve a dispute. At Design Professional, we believe strongly in the power of mediation, and we do all we can to help you prepare for it, bringing you expert guidance about everything from choosing the right participants to signing a settlement authorization.

When you resolve a dispute through mediation during the first year, you can receive up to 75% of your deductible back (50% thereafter), up to $25,000.

  • Litigation may be the best option
Our attorneys have years of experience representing design professionals, and they understand the complexities of the law in your field. Should your case go to court, they will use their considerable expertise to protect your interests. They will help you prepare for litigation, including gathering relevant documents, locating expert witnesses, assisting with discovery and more. They will help you preserve your client relationships and your firm's reputation. Finally, defense counsel will serve as your advocate in court.
